1. Acceptance of Terms
By downloading, installing, or using the WakeButler application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
2. Description of Service
WakeButler is an alarm clock application that uses artificial intelligence to calculate alarm times based on your calendar events and personal preferences. The App relies on third-party services including OpenAI and Google Firebase to provide its features.
3. Eligibility
The App is intended for persons aged 16 and older. By using the App, you confirm that you are at least 16 years old or have the consent of a parent or legal guardian.
4. Disclaimer of Reliability — No Guarantee of Alarm Functionality
The App is provided "as is" and "as available" without any warranty of any kind, express or implied.
In particular, we do not guarantee that:
- Alarms will trigger reliably, on time, or at all.
- The AI-calculated alarm times will be accurate or suitable for your needs.
- The App will function without interruptions, errors, or delays.
- The App will work correctly after operating system updates, device changes, or changes in third-party services.
You acknowledge and agree that you use the App at your own risk. WakeButler shall not be used as your sole or primary means of waking up for critical appointments, flights, exams, job interviews, medical appointments, or any other time-sensitive obligations.
The foregoing limitations do not affect your statutory warranty rights as a consumer.
5. Limitation of Liability
To the maximum extent permitted by applicable law, (doing business as WakeButler), its directors, employees, and affiliates shall not be liable for any:
- Missed appointments, meetings, flights, deadlines, or any other events.
- Oversleeping or late arrivals caused by the App failing to trigger an alarm.
- Financial losses, lost income, or consequential damages of any kind.
- Damages arising from incorrect AI-generated alarm times.
- Damages resulting from service outages, bugs, or technical failures.
The above limitations of liability do not apply to damages arising from injury to life, body, or health, nor to damages caused by intentional or grossly negligent breaches of duty by the provider or its legal representatives or agents. Liability for breach of material contractual obligations (cardinal obligations) remains unaffected but is limited in amount to the typical, foreseeable damage in cases of slight negligence. In all other respects, the above limitation of liability applies regardless of the legal basis of the claim.
6. User Responsibility
You are solely responsible for:
- Ensuring you have a backup alarm or alternative method to wake up for important obligations.
- Verifying that alarm times set by the App are correct before relying on them.
- Granting the App the necessary permissions (notifications, calendar access, battery optimization exemption) for proper functionality.
- Keeping your device charged and in a state that allows alarms to sound.
7. Subscriptions and Payments
Some features of the App require a paid subscription ("WakeButler Pro"). Payments are processed exclusively through Apple App Store or Google Play Store. Subscription terms, pricing, and cancellation policies are governed by the respective platform's terms. We do not process or store payment information directly.
8. Intellectual Property
All content, features, and functionality of the App are owned by and are protected by applicable intellectual property laws.
9. Data Protection
For information about the collection and processing of personal data, please refer to our Privacy Policy. The Privacy Policy forms an integral part of these Terms of Service.
10. Termination and Account Deletion
You may stop using the App at any time by uninstalling it from your device. If you have a paid subscription, you must cancel it separately through the respective app store. To delete your stored data, you can contact us via the options provided on our support page or submit a request through our data request form.
11. Changes to Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted within the App or on our website. Your continued use of the App after changes constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany. The place of jurisdiction is the registered office of the company, to the extent permitted by law.
13. Severability
Should any provision of these Terms of Service be or become invalid, the validity of the remaining provisions shall not be affected.
